Acceptance of Terms

By accessing, browsing, or using the Nankira website (www.nankira.com) and placing orders, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with all policies referenced herein. If you do not agree to these terms, please discontinue use of our website immediately.

Eligibility and Account Registration

  1. Purchasing privileges are restricted to individuals aged 18 years or above or the age of majority in your jurisdiction, whichever is higher.
  2. You must provide accurate, current, and complete information during registration and maintain the accuracy of such information.
  3. Account credentials (username, password, OTP) are your sole responsibility and must be kept strictly confidential.
  4. You are responsible for all activities conducted through your account.
  5. Sharing account credentials or allowing unauthorized access violates these terms and may result in account suspension.
  6. You must notify us immediately at care@nankira.com if you suspect unauthorised account access.

Product Information and Pricing

  1. All product descriptions, specifications, and images are provided in good faith for representational purposes.
  2. Actual products may exhibit minor variations in colour, design, or appearance due to photographic lighting, display settings, or manufacturing tolerances. Plating may appear more lustrous in photography than in person.
  3. Product pricing remains subject to modification without advance notification due to market conditions, supplier costs, or business requirements.
  4. Prices displayed are in Indian Rupees (INR) and include applicable Goods and Services Tax (GST).
  5. We make reasonable efforts to ensure pricing accuracy, but errors may occur. If a product is listed at an incorrect price due to system error, we reserve the right to cancel the order and notify you.

Order Acceptance and Processing

  1. Submission of an order constitutes an offer to purchase products subject to these terms.
  2. The company reserves unilateral discretion to accept or decline any order submission based on product availability, pricing errors, suspected fraudulent activity, or violation of terms.
  3. All orders remain contingent upon product availability and inventory confirmation.
  4. We will send order confirmation via email, but this does not constitute order acceptance.
  5. Order acceptance occurs only when products are dispatched from our warehouse and you receive shipment notification.

Lawful Use and Prohibited Activities

You agree to use our website only for lawful purposes and in compliance with all applicable laws and regulations. Specifically, you agree NOT to:

  1. Violate any local, state, national, or international law or regulation
  2. Infringe upon or violate our intellectual property rights or the intellectual property rights of others
  3. Transmit any material that is defamatory, obscene, offensive, or harmful
  4. Engage in any conduct that restricts or inhibits anyone’s use of the website
  5. Use any automated system (bots, scrapers, crawlers) to access or extract data from the website without written permission
  6. Attempt to gain unauthorized access to any portion of the website or any systems or networks connected to the website
  7. Upload or transmit viruses, malware, or any other malicious code
  8. Engage in fraudulent activities including use of stolen payment information, false identity, or manipulation of our systems
  9. Create multiple accounts to circumvent restrictions or exploit promotional offers
  10. Resell products purchased from Nankira for commercial purposes without authorization
  11. Manipulate pricing, inventory, or promotional systems

Account Suspension and Termination

The company reserves the right to suspend or terminate accounts engaged in:

  1. Fraudulent activities or suspected fraudulent behavior
  2. Violation of any policy provisions or terms of service
  3. Abusive behavior toward customer service representatives or other users
  4. Excessive returns indicating potential abuse of our return policy (per Fair Usage Policy)
  5. Chargebacks or payment disputes filed without prior contact with customer service
  6. Any activity that harms or could potentially harm Nankira’s business, reputation, or other customers

Account termination may result in forfeiture of store credits, cancellation of pending orders, and prohibition from future purchases. In cases of egregious violations, we reserve the right to pursue legal remedies.

Limitation of Liability

While we strive to provide quality products and reliable services, the following limitations apply:

  1. Fashion jewelry is designed for occasional wear; plating and finishes may naturally wear over time with use
  2. Product colors, textures, and designs may appear different from images due to screen settings, lighting conditions, and individual device calibration
  3. We are not liable for delays caused by natural disasters, pandemics, government actions, strikes, civil unrest, or other circumstances beyond reasonable control (force majeure events)
  4. We are not responsible for third-party service failures including payment gateway errors, courier service delays, or bank processing times beyond our direct control
  5. Our total liability for any claim arising from your use of our website or purchase of products shall not exceed the amount you paid for the specific product giving rise to the claim
  6. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, data loss, or business interruption

Indemnification

You agree to indemnify, defend, and hold harmless Nankira Private Limited, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  1. Your violation of these Terms and Conditions
  2. Your violation of any rights of third parties
  3. Your misuse of the website or products
  4. Your provision of inaccurate or misleading information

Governing Law and Dispute Resolution

  1. These terms are governed by the laws of India without regard to conflict of law provisions
  2. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of courts in Greater Noida, Uttar Pradesh, India. 
  3. Before initiating any legal proceedings, parties agree to attempt good-faith resolution through our Grievance Redressal Mechanism
  4. Nothing in these terms affects your statutory rights under the Consumer Protection Act, 2019, or your right to approach consumer forums

Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by an authorized representative of Nankira.

Consumer Rights Protection

Nothing in these terms affects your statutory rights under the Consumer Protection Act, 2019. You always retain the right to:

  1. Approach consumer forums for dispute resolution
  2. Seek remedies under consumer protection laws
  3. File complaints with appropriate regulatory authorities
